Hearing of Najib, govt's bid to strike out Tony Pua's suit June 15

KUALA LUMPUR, May 17 (Bernama) -- The High Court today fixed June 15 to hear applications by Prime Minister Datuk Seri Najib Tun Razak and the Malaysian government to dismiss a suit filed by Petaling Jaya Utara MP Tony Pua Kiam Wee over alleged misconduct involving 1Malaysia Development Berhad (1MDB) funds.

Judicial Commissioner Datin Faizah Jamaludin fixed the date in chambers in the presence of counsel Nik Alia Hanafi, representing Najib, senior federal counsel Zureen Elina Mohd Dom, representing the Malaysian government, and counsel Joanne Chua, on behalf of Pua.

Najib filed the application to strike out Pua''s suit on Feb 14, on grounds that he is not a civil servant as alleged by Pua in his statement of claim, and that the suit is also an abuse of the court process.

The government also filed an application to strike out the suit on March 2 on grounds that Pua has no locus standi to make the claim and that the suit is frivolous, vexatious and does not disclose a reasonable cause of action.

On Jan 16, Pua, as plaintiff, sued the government and Najib as first and second defendants, claiming that Najib committed misfeasance in public office involving 1MDB funds. He is seeking general, aggravated and exemplary damages, costs, and other relief deemed fit by the court.
